Why children's products face the toughest compliance

The Consumer Product Safety Improvement Act (CPSIA) treats every children's product as high-risk by default. There are no shortcuts and no exemptions.

Children's Product Certificate (CPC)

Every children's product sold in the US requires a CPC backed by third-party testing from a CPSC-accepted laboratory. No self-certification allowed.

Third-Party Testing Mandate

Unlike adult apparel, children's products must be tested by an accredited lab for lead, phthalates, flammability, and small parts. Every production run needs fresh test results.

Permanent Tracking Labels

Each product must have a permanent, distinguishing mark with manufacturer name, production date, batch number, and location. Sewn-in labels that survive washing.

DEADLINE

CPSC eFiling — July 8, 2026

Starting July 8, all children's product imports must submit electronic filing certificates through CPSC's system. Paper certificates will no longer be accepted at port of entry. Brands without eFiling capability will face shipment holds and potential seizure.

Common mistakes children's brands make

Using adult-product test reports

Adult apparel GCCs do not satisfy CPC requirements. Children's products need separate testing to CPSIA standards including 16 CFR Part 1501 (small parts) and ASTM F963.

Skipping tracking label requirements

Hang tags are not tracking labels. CPSC requires permanent marks that identify the specific production batch. Missing labels can trigger a full product recall.

Assuming Disclaimer B applies

The Disclaimer B exemption that saves adult apparel brands from third-party testing does not apply to children's products. Period. Every batch must be lab-tested.
